2. The collection and storage of personal data and the nature and purpose of their use

2.1 … during your visit to our website

When you visit our website www.pony-branding.com, the browser used on your terminal device automatically sends information to the server of our website. This information is temporarily stored in a so-called log file. This is only information that does not allow any conclusions to be drawn about your person.

The following information is collected in anonymous form and then statistically evaluated by us:

We pass on your personal data according to Art. 6 Section 1 DSGVO to third parties only if:
_ this is legally permissible and necessary for the processing of contractual relationships with you,
_ the disclosure is necessary for the performance of our activities and there is no reason to assume that you have a predominant interest worthy of protection in not disclosing your data,
_ you have given your express consent or
_ there is a legal obligation to disclose.

4. Storage time of data

The provisions of the Federal Data Protection Act (BDSG) apply. PONY BRANDING + DIGITAL DESIGN ensures by technical and organizational measures that the regulations over the data security are considered at any time and in its entirety. External service providers, which we may use, are then selected and are obliged to do the same.

PONY BRANDING + DIGITAL DESIGN stores and processes your personal data for the duration of the business relationship; this includes the period from initiation to final processing.

In addition, we are subject to various storage and documentation obligations, including those arising from the German Commercial Code (HGB) and the Fiscal Code (AO). The duration of the storage of your data depends on the statutory limitation periods (such as §§ 195 ff. BGB).

We will delete your data after expiry of the storage and documentation obligations and the relevant limitation periods.

In accordance with the Commission’s adequacy decision (C/2016/4176 of 12 July 2016 (http://data.europa.eu /eli/dec_impl/2016/1250/oj)), the transfer of your information to a third country outside the EU is covered within the meaning of Art. 45 DSGVO: Google has undertaken to comply with the principles of the EU-US Privacy Shield. Google will act on our behalf as a processor within the meaning of Art. 28 DSGVO.

8. Customer acquisition / client retention

8.1  E-Mail-Marketing

We use your e-mail address to inform you occasionally by e-mail about offers, news and developments and to invite you to events only if you have expressly consented. In order to receive such e-mails, it is necessary to provide your e-mail address as well as your name and surname and the company concerned.

If you wish to unsubscribe, you can do so at any time via the “Unsubscribe Newsletter and Invitations” link located at the end of each of our e-mails. If you wish to unsubscribe, you can also send them an e-mail to hallo@pony-branding.com. In this case, your e-mail address will be deleted from our e-mail distribution list and added to our blacklist.

Please note that we statistically evaluate the behaviour of the recipients of our e-mails in anonymous form. We record the time when the e-mail was opened and forwarded, when the links contained therein were clicked, the IP address and the e-mail program used. For this reason, the e-mails contain so-called web beacons / tracking pixels and links, each of which is linked to an individual ID.

The evaluation of our e-mail marketing serves us to offer you interesting topics and to constantly improve us.

If you unsubscribe from our e-mail distribution list or delivery failed, we will also receive information about your name and e-mail address. This is (also) in your interest, so that we can immediately solve the delivery problem or delete you from our e-mail distribution list.

8.2 Client retention

PONY BRANDING + DIGITAL DESIGN informs its customers from time to time by e-mail or letter about offers, news and developments and/or invites them to events.

The legal basis for the necessary data processing can be found in Art. 6 section 1 DSGVO. According to Art. 47 DSGVO, our legitimate interest lies in direct advertising.

You can of course object to the use of your e-mail address and postal address for advertising purposes at any time.

9. Social media and news service plugins

We use social media plugins and a news plugin on our website.

_ This page uses “facebook”, a social network. Facebook allows the creation of profiles to present oneself, to present companies and to discuss between groups with common interests. The profiles can be linked to each other by friend requests.

The plugins are used to provide users with convenient access and to make PONY BRANDING + DIGITAL DESIGN better known via selected social media channels facebook and Google+ as well as the Twitter news service.

You can recognize the respective provider of the plugin by its name and logo. We offer you the possibility to communicate directly with the provider of the plugin via the button and use the “Shariff solution”. This means that when you visit our website, no personal data is initially passed on to the plugin providers.

By clicking on the logo/link (the activation of the plugin) and using the functions of the above service providers embedded on our website, you agree to the collection, processing and use of the automatically collected and entered data by the respective service providers – as well as their representatives or third party providers – in accordance with the respective terms of use and data protection provisions.

PONY BRANDING + DIGITAL DESIGN has no knowledge of and no influence on the collection and processing of data collected by social media providers and Twitter. The same applies to scope, purpose, storage periods and deletion.

By activating the plugin, personal data is transmitted to the respective service provider and stored in the USA. The data transfer takes place regardless of whether you have an account with the plugin provider and are logged in there. If you are logged in with the plugin provider, your data – collected via our website – will be directly assigned to your existing account with the service provider, stored and communicated to your contacts / your network publicly.

We therefore recommend that you consciously log in and out for each use. This is the only way to remain in control of the procedure. 10. Rights of the data subject

You have the following rights with regard to the personal data we have stored about you:

If we process your personal data on the basis of legitimate interests pursuant to Art. 6 section 1 DSGVO, you have the right, pursuant to Art. 21 DSGVO, to object to the processing of your personal data if there are reasons for doing so which arise from your particular situation or the objection is directed against direct advertising. In the latter case, you have a general right of objection, which is implemented by us without stating a particular situation.

If we process your personal data on the basis of your consent in accordance with Art. 6 section 1, you have the right – in accordance with Art. 7 section 3 DSGVO – to revoke your consent given to us at any time. As a result, we may no longer continue the data processing based on this consent in the future.
